Terms and Conditions

1. This customer Incentive  (“The Incentive”) is conducted by Royal Canin South Africa (Pty) Ltd (“Royal Canin”) for its Eukanuba™ products.
2. Royal Canin owns and manages the website at https://healththroughnutrition.co.za.
3. Although Royal Canin will take all reasonable steps, it will not be liable for any technical problems or any lost, delayed, or incorrectly received entries.
4. The Incentive will run between 08 July & 02 September 2024 (both days inclusive).
5. To enter the Incentive, customers (“Participant”) must submit photographs of images taken at their outlet which is participating in the promotion (“Participating Outlet”) which includes Eukanuba™ In-Store Point-of-Sale and captured between 08 July & 02 September 2024 (both days inclusive). These photographs from the Participating Outlet together with the required information must be submitted on the Royal Canin Store Incentive webpage (promo.healththroughnutrition.co.za/eukpromo-store) before midnight on 02 September 2024.  By doing so, the participant will create 1 (one) entry into the Incentive, thereby becoming a “Participant” in the Incentive. The entry will contain the submission of photographs of In-Store Point-of-Sale utilising Eukanuba™ brand assets provided to the customers and will be calculated toward the Participant’s entry.
6. By entering the Incentive, the Participant agrees to be bound by these terms and conditions (“Terms”) in their entirety. These rules, should they require interpretation, will be interpreted by Royal Canin in its sole and absolute discretion, but in accordance with applicable law.

8. You are not eligible to participate in the Incentive if:
   1. you are a director, member, partner, employee, agent, or consultant of Royal Canin, its affiliates/divisions/subsidiaries/holding companies, or any other person who supplies goods or services in connection with the Incentive; or
   2. you are a spouse, life partner, parent, child or sibling, immediate family member, business partner, or associate of the persons specified in the above-mentioned clause.
9. The Reward will be a R1,000 credit to the customers stores account for a minimum of one photograph of an in-store display utilising Eukanuba™ materials supplied. Rewards will not be redeemable for cash and are non-transferable and acceptance thereof cannot be deferred.
10. Reward winners (“Winners”) will be determined from the 1 valid entry from each Participating Outlet within 1 month of the closing date (midnight on 02 September 2024) by means of reviewing all photograph submissions in line with the detailed and communicated incentive mechanics. For a limit of a minimum of one photograph of an in-store display utilising Eukanuba™ materials supplied , 1 x R1,000 credit will be rewarded to the participating outlet account held with Royal Canin.
11. Winners will be notified via email or telephonic correspondence. Reward will be issued directly to the participating outlet’s account by 30 September 2024.
12. All participants agree that their images, and testimonials may be used in any promotional and/or advertising for the purposes of marketing, which permission may however be revoked by any Participant at any time.
13. Winners may be required (but are not obliged) to provide such additional information that Royal Canin may reasonably require in order to process and facilitate their acceptance and/or use of a prize.
14. No correspondence will be entered into in regard to the choice of the Winners.
15. Royal Canin does not make any representations or give any warranties, whether expressly or implicitly, as to the Reward and makes no representations and gives no warranty that any Participant’s entry will necessarily result in that Participant winning.
16. Royal Canin reserves the right to suspend or postpone the Incentive, or any aspect thereof, for any reasons whatsoever and with notice to Participants. In such an event, Participants hereby acknowledge that they will not have any recourse or claim of any nature against Royal Canin as a result of its decision in terms of this clause 19.
17. Royal Canin reserves the right to disqualify any Participant who commits dishonesty, fraud, or cheating including without limitation, through the manipulation of photographs or otherwise falsifying data.
18. Royal Canin will be entitled to use the personal information of Participants received pursuant to their participation in the Competition in accordance with all applicable laws and regulations and the privacy policy available on the website (https://www.mars.com/privacy-policy).
19. By participating in the Incentive, you consent to:
    1. the processing of your personal information (as defined in the Protection of Personal Information Act 4 of 2013 (“POPIA”)) by Royal Canin, any of its operators, agents and sub-contractors (who may be outside South Africa) for statistical, marketing and other purposes, on the condition that they will keep such information confidential and only process such information as allowed in terms of POPIA;
    2. the collection of your personal information from any other source to supplement the personal information which Royal Canin has about you as allowed in terms of POPIA;
    3. the retention by Royal Canin of your personal information for as long as permitted for legal, regulatory, fraud prevention and/or marketing purposes as allowed in terms of POPIA; and
    4. Royal Canin using your personal information (as allowed in terms of POPIA) to send you marketing information about products, services, and special offers of the various companies in the Royal Canin group that may be of interest or value to you.
20. The Incentive is sponsored by Royal Canin for its Eukanuba™ product range and is not associated with any brands or organisations.
21. These terms and conditions will be construed, interpreted and enforced in accordance with the laws of contract and dispute resolution in the Republic of South Africa.;
22. To the extent permitted by applicable laws and regulations including the Consumer Protection Act 68 of 2008, Royal Canin disclaims liability however arising and you hereby indemnify and hold harmless Royal Canin, its holding companies and/or its subsidiaries/affiliates (including their directors, employees, members, independent contractors, agents, consultants, sub-contractors and other representatives) from any and all loss/damages that may be sustained directly/indirectly arising out of/pursuant to the Competition or resulting from the acceptance of and/or possession of and/or use of the prize/s on offer, including but not limited to loss/damages arising out of/pursuant to personal injury, death, property damage and claims based on publicity rights, defamation and/or privacy rights.
23. This document constitutes the sole record of the agreement between Royal Canin and the Participants in relation to the subject matter hereof. Royal Canin shall not be bound by any express, tacit or implied term, representation, warranty, promise or the like not recorded herein. This document supersedes and replaces all prior commitments, undertakings or representations, whether oral or written, between Royal Canin and the Participants in respect of the subject matter hereof.  No addition to, variation, novation or agreed cancellation of any provision of this document shall be binding upon Royal Canin unless reduced to writing and signed by or on behalf of Royal Canin.
